On the 16 September 2024, Tauranga City Council resolved that the following places are temporary alcohol-free areas:
- All beaches, reserves and public places on the seaward side of Marine Parade (eastwards from its intersection of Grove Avenue), Oceanbeach Road, Maranui Street Surf Road, Yale Street and Sunbrae Grove from 21 October 2024 to 6 April 2025 between the hours of 9pm and 7am.
Council also clarified:
- That during the period from 26 December 2023 to 6am on 6 January 2024, a temporary alcohol-free area is in place, 24 hours a day, seven days a week, for:
(i) All beaches, reserves and public places on the seaward side of Marine Parade (eastwards from its intersection of Grove Avenue to its intersection of Tweed Street)
(ii) Omanu Surf Club and car park area
(iii) Waiariki Street.
Police powers of arrest, search and seizure
(Sections 147, 169, 170(1) and 170(2) of the Local Government Act 2002)
Police may search and seize, without warrant, any container (e.g. bag, case, package or parcel) a person is carrying in an alcohol-free area as well as any vehicle that is in, or entering, an alcohol-free area.
Police may also arrest any person found to be committing an offence, including refusing to comply by leaving the alcohol-free area or surrendering any alcohol in their possession.
